Exporting spirits outside the EU: the AES export declaration and discharging the e-AD

Last reviewed: 21 Sep 2026 · 6 min read

In short

An export from a tax warehouse runs in two procedures at once. The export declaration settles customs, the e-AD settles excise. The ARC links them. Once the customs office of exit confirms that the goods have left, the exit confirmation is issued and EMCS closes the movement with the report of export.

Two procedures run side by side

When a pallet of whisky leaves the tax warehouse for Switzerland, you handle the same vehicle in two separate systems. Customs requires an export declaration in the German export system, ATLAS Ausfuhr. Excise requires an e-AD in EMCS, because the goods leave the warehouse duty unpaid. The two systems know about each other only through one shared number.

That number is the ARC from the e-AD. It goes into the previous document data group of the export declaration, in exactly that form since AES 3.0. If it is missing or mistyped, the two cases run past each other and the reconciliation at the office of exit fails.

Who owns which part is often left unclear. The exporter has to be established in the European Union, which pushes the role back onto the seller when the customer sits overseas. A customs representative can file the declaration for you, but responsibility for the entries stays with the exporter. The e-AD, by contrast, is always raised by the keeper of the dispatching warehouse, whoever owns the goods.

Where the two procedures meet

In the draft e-AD the destination is not the customer in the third country but the competent customs office. Field 8a holds the reference number of the customs office of export. Under the single stage export procedure in Article 221(2) second sentence UCC IA, the office of exit goes there instead, meaning the last customs office before the goods leave the excise territory.

Small consignments carry one peculiarity. For excise goods under duty suspension the export declaration has to be filed electronically even where the value is below 1,000 euros. An oral declaration is ruled out because other special formalities apply (Article 142(d) UCC DA). In practice this catches sample deliveries to importers and entries sent off to competitions, which people like to hand over informally.

Seven steps to an export

  1. Check availability. Reconcile stock, batches and labels for the destination country before confirming a date.
  2. Raise the export declaration. Record the product description, commodity code, gross and net mass, exporter and consignee.
  3. Create the e-AD. Enter the customs office as destination, then the product, the alcoholic strength and the quantity, and submit the draft.
  4. Link the ARC. Carry the validated ARC into the export declaration as the previous document.
  5. Load. The driver gets the accompanying document with the ARC, the consignment note and the commercial papers.
  6. Pass the office of exit. It reconciles the data and confirms that the goods have left.
  7. Close the case. EMCS generates the report of export and the main customs office passes it to the consignor.

The exit confirmation and what you need it for

The movement under duty suspension ends when the alcohol products leave the excise territory of the European Union (section 16 AlkStG). The exit confirmation, in German the Ausgangsvermerk, is the proof that the goods have left the customs territory. It is your evidence towards the tax office for the VAT exemption of the export supply, and at the same time the trigger on the excise side. The report of export in EMCS is generated automatically from the exit confirmation issued in the export system.

If the interface between the two systems is unavailable, the EMCS case is held back and processed later. Nothing is lost. Where the confirmation is still missing weeks later, technology is almost never the reason. It is a difference between what was declared and what was actually loaded.

If exit stays unconfirmed despite chasing, the customs office of export can establish it on request using alternative evidence. A consignment note endorsed by the carrier, a receipt from the customer in the country of destination, or the import clearance there will usually do. Collect those documents from the start rather than hunting for them at the forwarder months afterwards.

A partial export is a one way street

If only part of the declared quantity actually goes, EMCS treats the remainder as a shortage. A change of destination for that remainder is no longer possible afterwards. Where it is foreseeable that not everything will fit, the clean answer is a smaller declaration rather than a later correction.

United Kingdom and Switzerland

On an export to the United Kingdom your responsibility ends with exit from the EU. A separate procedure starts on the British side, because UK Alcohol Duty falls due once the goods are released for consumption there. Deliver into a British excise warehouse and the duty stays suspended for the time being. The sales contract should settle this point, because it moves the price considerably.

Switzerland charges its own levy on spirits and requires an import declaration from the importer there. The short distance helps, because the office of exit often sits only a few hours away and the exit confirmation comes back quickly. For you that means the case usually closes the same day.

United States and Asia

For the United States the importer needs a federal permit, and labels have to be approved in advance. Without that approval the container sits in the port even though everything is correct on the customs side. Settle early who holds the label approval and whether it matches the batch you are shipping.

Across Asia the requirements differ sharply by country. Certificates of analysis, health certificates and evidence about additives are commonly asked for. Allow lead time on a first delivery, because some documents have to travel as originals by courier. How we handle export consignments is set out on the page about export outside the EU.

Mistakes that leave the case open

The most common one is a product description pulled straight from a stock system that says nothing to customs. If the field holds a category instead of the brand and the expression, the declaration does not match the load. Just as often the net and gross mass are inconsistent, because carton weights were estimated rather than weighed.

A third point is the place of presentation. If it names an address where the goods cannot in fact be presented, clearance slows down. Check those entries before you file, and the exit confirmation will usually arrive without a query. If you would like to talk through a planned export consignment, send us a short message.

Frequently asked questions

Do I need both procedures, AES and EMCS, for an export?

Yes, where the goods leave the tax warehouse duty unpaid. The export declaration settles the customs side and the e-AD the excise side. The two are linked through the ARC.

Is there a value threshold below which no export declaration is needed?

Not for excise goods under duty suspension. The declaration has to be electronic even where the value is below 1,000 euros, because other special formalities apply.

When does the movement end on an export?

When the goods leave the excise territory of the European Union (section 16 AlkStG). The customs office of exit confirms departure, and EMCS generates the report of export to the consignor from that.

What if only part of the consignment is exported?

The quantity not exported counts as a shortage in EMCS. A change of destination for that remainder is no longer possible, so the case has to be cleared up instead.

Who is liable if the exit confirmation never arrives?

The consignor, meaning the dispatching tax warehouse. Without evidence of exit the goods count as released for consumption, and the excise duty can be assessed.

Does the consignee outside the EU have to declare anything?

Almost always. Import formalities in the country of destination sit with the importer there, including local alcohol duty and labelling requirements.
